For the purposes of these Terms and Conditions, it is understood that the activity which Active Friendship Workshop develops through the Website comprises:
A workshop for English-speaking expats and any resident of Tenerife who wishes to find new friends in a proper manner. The activity consists of the organization and facilitation of a ten-session in-person workshop designed to foster social connection and the development of interpersonal skills. The service is strictly limited to the facilitation of the scheduled sessions and does not include the supervision of the private activities of participants outside of the workshop hours.
In addition to reading these Terms, before accessing, browsing and/or using this webpage, the User shall have read the Legal Notice, the General Terms of Use, including the cookie policy, and the privacy and data protection policy of Active Friendship Workshop. 3. PURCHASE OR ACQUISITION PROCESS
Duly registered Users may purchase on the Website through the specified methods and forms. They shall follow the online purchase and/or acquisition procedure of foundersfriendship.com, during which various products and/or services may be selected and added to the cart, basket, or final purchase area, and finally, click on: “Pay registration fee (€50)”

4. AVAILABILITY
All purchase orders received by Active Friendship Workshop through the Website are subject to product availability and/or that no circumstance or force majeure event (clause nine of these Conditions) affects the supply thereof and/or the provision of the services. Should difficulties arise regarding product supply or products become out of stock, Active Friendship Workshop undertakes to contact the User and refund any amount which may have been paid as consideration. This shall also apply in cases where the provision of a service should prove to be unrealizable.
5. PRICES AND PAYMENT
The prices displayed on the Website are final, in Euros (€), and include taxes, except where legally required, particularly concerning VAT, a different matter is indicated and applied.
Notwithstanding, and unless otherwise specifically indicated, the prices of the offered articles exclude shipping costs, which may be incurred, and will be added to the total amount due at the time the User manages the shipping procedure. At that time, the User will consult the available shipping methods and costs and will freely choose the most suitable option.
Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has selected and chosen voluntarily and freely.
Prices may change at any time, but such changes shall not affect orders or purchases with respect to which the User has already received an order confirmation.

6. Service Confirmation and Delivery
Given that this involves contracting for a place in an in-person workshop, no physical delivery of goods is performed.
Once the purchase process is complete and payment is confirmed, the User will receive a confirmation email granting them the right to attend the Active Friendship Workshop on the date, time, and location specified on this Website.
The User shall attend the designated location to validate their registration. Active Friendship Workshop reserves the right to cancel or postpone sessions due to force majeure, in which case the User will be notified with as much possible advance notice and offered alternatives or the corresponding refund.
7. TECHNICAL MEANS FOR CORRECTING ERRORS

8. RETURNS
In cases where the User acquires products on or through the Website of the Data Controller, they are entitled to a number of rights, as detailed below:
Right of Withdrawal
The User, acting as both consumer and user, makes a purchase on the Website and, accordingly, has the right to cancel said purchase within a period of fourteen (14) natural days without the need for justification.

In the event of withdrawal, Active Friendship Workshop shall refund to the User all payments received, including shipping costs (with the exception of additional costs selected by the User for a shipping method different from the least costly option offered on the Website) without undue delay and, in any event, no later than 14 natural days from the date on which Active Friendship Workshop is informed of the User’s decision to withdraw.
Active Friendship Workshop will refund the User utilizing the same payment method employed by the User to perform the initial purchase transaction. The User acknowledges being aware that there are exceptions to the right of withdrawal, as recorded in Article 103 of Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws. Once this 48-hour period has elapsed, or once the second session of the workshop has commenced, the User acknowledges that the service is considered effectively initiated and will forfeit their right to a refund for the remaining sessions, in accordance with legal exceptions for services in progress.
In any case, no refund will be issued if the product has been used beyond the mere opening of the packaging, if the products are not in the same condition as they were delivered, or if they have sustained any damage after delivery.
Furthermore, products must be returned utilizing or including all original packaging, instructions, and any other documents which may accompany them, along with a copy of the purchase invoice.

9. LIMITATION OF LIABILITY
Save for any contrary legal provision, Active Friendship Workshop will not accept any responsibility for the following losses, notwithstanding their origin:
- any losses not resulting from any breach of their part;
- business losses (including loss of anticipated profits, loss of revenue, loss of contracts, loss of anticipated savings, loss of data, loss of goodwill, or unnecessary expenses incurred); or of
- any other indirect loss that was not reasonably foreseeable by both parties at the time the purchase agreement for the products was entered into by both parties.
Similarly, Active Friendship Workshop also limits its liability as to the following cases:
Active Friendship Workshop undertakes all measures pertaining to the provision of a faithful representation of the product on the Website; however, it assumes no responsibility for minor discrepancies or inaccuracies that may exist due to inadequate screen resolution, issues with the browser being used, or matters of a similar nature.
- Active Friendship Workshop shall act with due diligence to make the product subject to the purchase order available to the company responsible for its transport. - Acts, decrees, legislation, regulations, or restrictions of any government or public authority.
- Participants declare to be independent adults and to be fully responsible for their own safety, emotional well-being, and personal choices during and after the workshop.
- The provision of the service and the facilitator’s responsibility strictly terminate at 20:00 hours of each Saturday session.
- Active Friendship Workshop shall not be responsible for any conduct, interaction, or result (including personal, financial, or physical damages) resulting from private meetings or relationships formed between members outside the scheduled hours and specific scope of the workshop.
In this way, the obligations shall be suspended for the period during which the force majeure event continues, and Active Friendship Workshop shall be granted an extension of time to perform them for a period equal to the duration of the force majeure event. Active Friendship Workshop shall use all reasonable means to find a solution that enables it to fulfill its obligations despite the force majeure event.
10. WRITTEN COMMUNICATIONS AND NOTICES
By using this Website, the User agrees that most communications with Active Friendship Workshop shall be electronic (via email or notices published on the Website).
For contractual purposes, the User consents to use this electronic means of communication and acknowledges that all contracts, notifications, information, and other communications sent by Active Friendship Workshop electronically shall satisfy the legal requirements of being in writing. 12. NULLITY
If any of these Terms and Conditions are declared invalid and unenforceable by a final ruling issued by a competent authority, the remaining clauses shall remain in effect and shall not be affected by such declaration of invalidity.
13. ENTIRE AGREEMENT
These Conditions and any document expressly referred to herein constitute the entire agreement existing between the User and Active Friendship Workshop with respect to the subject matter of the sale and supersede any other prior agreement, pact, or promise, whether oral or in writing, between the same parties.
